Hi All,

I have been working in a Government Institution (Medical college) as a clerk/computer operator for 4 years and now need to withdraw my PF amount. In this institution, agencies have changed every 11 months. The first agency continued for two and a half years, and the second agency for 13 months. However, the second agency only paid my PF amount for 13 months, despite me giving them Form No. 13 to transfer the old PF account. I now wish to claim the PF amount from the first agency. When I approached the head of the first agency for the amount, he did not respond and did not process my Form No. 19.

I recently learned from TV news and advertisements that from 1.4.2011, if we do not withdraw our PF amount within three years, it will dissolve from our account.

Please suggest how I should proceed. I do not want to spoil the relationship with the agency but also need to withdraw the amount. Is it possible for me to withdraw the amount using the PF number without the agency's knowledge, or do you have any other solutions? Your guidance on what to do would be appreciated.

Can someone please let me know the following:

My brother worked in a reputed organization (MNC) and left after one year, but did not withdraw PF and never got it transferred to his PF account maintained with his new employer. It has been almost four years now.

Can we now get this outstanding amount transferred to his new PF account maintained with his current employer and submit the form to the Provident Fund office?

As of now, the PF department has taken several steps but all in vain. First of all, claims should be settled within a month of submission, or the PF commissioner would be liable for that. I have seen cases pending for years at the Noida PF office, and the commissioner is not available most of the time in the office.

They tried to introduce a debit card scheme for its members. I filled out the form three years ago but am still waiting for that card. So, I don't think these things are going to improve until accountability is enforced on the PF officials. Currently, each PF office operates differently. I am not hopeful about this. It needs some hard steps against PF officials.

Dear Krishan,

Yes, it can be transferred now along with the interest amount accrued from the contributions in the previous company. You need to fill out the transfer form and submit it to your current employer or directly at the PF office. They will then send it to the previous employer for verification, and after that, your balance should be transferred to your new account.

For better understanding, you should contact your HR or Finance department, who deals with the PF office.

Dear Krishan,

No need to worry in your case. Nobody can touch your PF amount, not even the President. It's a right for everybody. You just need to fill in the PF transfer form with duly filled details like your PF number, address of the previous employer, and date of resignation. Please make two copies and submit them to your HR; they will do the needful. However, the transfer of PF takes time, sometimes up to 6 months, so hold on to your patience and watch.

Thank you for the information. In the meanwhile, can anyone tell me what is the maximum percentage of contribution that can be made towards the Voluntary Provident Fund, assuming Rs. 10,000/- as basic wages.

Dear Balaji,

Regarding Voluntary PF Contribution, you can contribute up to 100% of your Basic. The PF Act does not stipulate any limit to an employee's share in VPF contribution. In other words, from an employee's PF contribution perspective, it means 12% is the statutory contribution, and you can contribute the remaining 88% towards VPF.

So, if Basic is Rs 10,000, then the PF contribution is 12%, i.e., Rs 1200, and VPF can be contributed up to 88%, i.e., the remaining Rs 8800.

Please note that the employer is not required to contribute to the extent of VPF contributed by the employee. The employer's liability is restricted to the statutory contribution of 12% to PF.

Hi,

Can somebody tell me if I can withdraw my PF amount directly from the PF office in Mumbai? I had to part ways with my previous employer, and now they are creating vague and unnecessary circumstances to proceed with my full and final settlement. Please advise if I can directly approach the PF commission or PF office to withdraw my amount.

I know there is no requirement of contribution by the employer towards VPF contributed by the employee. I just required clarification on what is the maximum percentage with respect to VPF, that is it.
