Dear CL & SL cannot be encashed or accumulated. However, PL can be encashed and accumulated for up to 3 years (variable). In this regard, I am sending you a leave policy. If you require any other assistance, feel free to ask me.

Dear Salbins,

Earned Leave calculation

The Factories Act 1948 states:

Every worker who has worked for a period of 240 days or more in a factory during a calendar year shall be allowed, during the subsequent calendar year, leave with wages for a number of days calculated at the rate of:

(i) if an adult, one day for every twenty days of work performed by him during the previous calendar year; provided that the total number of days of leave that may be carried forward to a succeeding year shall not exceed thirty in the case of an adult or forty in the case of a child.

Casual Leave (CL) and Sick Leave (SL) can be granted by the management, but there is no specific rule for CL and SL.

Dear All,

Would you please answer my question with proper legal documents (i.e. rules and regulations of a limited company) supported?

My question is as follows: In recent developments in our company, the HR (management) decided and amended that paid leave (30 days as eligible) cannot be carried forward to the next financial year. All employees have to consume 30 days within that year itself. In any case not consumed, paid leave (PL) shall not be accounted for accumulation and shall expire the remaining days of unused leave.

Therefore, could you please inform me if there is any such rule for public limited (MNC) companies regarding carrying forward PL to the next financial year in case of not being fully utilized (i.e., balance unused PL)? Also, kindly explain the PL accumulation limit as per the standard rules.

Thank you.
