my wife has put my younger brother name in a false FIR registered under 498a,323,504,506,34 IPC sections as well as in a False domestic violence case and currently he is in final year engineering preparing for m.tech entrance,GATE. So,
Q.1 will the pending of these 498a and DV cases against him cause any hindrance whatsoever to his future admission to m.tech and p.hd course which he wishes to pursue?
If yes, how to avert any possible problems.?
Q.2 if the cases don't finish until he finishes his PG studies, will it affect his campus placement or future jobs in good MNC's or PSU's?
Are his chances to get into govt. Organisation over now for life?
Q.3 Also please let me know if it's better to let case go to full trial to get aqcquital and never compromise as I had read that compromise also has a negative impact on persons record.

Answer:

Q.1: The pendency of these cases should not directly impact your brother's admission to M.Tech or Ph.D. courses. Academic admissions usually consider academic performance and entrance exam scores. However, if the institute has a policy to check the legal background of applicants, it might pose a problem. Here's what you can do:

- 📚 Check the admission policy of the institutes he is applying to. If they have a clause about legal history, consider seeking legal advice.
- ⚖️ Consult with a lawyer to know how to present the case if asked about it during the admission process.

Q.2: The impact on future jobs, especially in government or public sector undertakings (PSUs), depends on the company policy. Many companies conduct background checks and any pending criminal cases could potentially impact his chances. Here's how to mitigate this:

- 🏢 Understand the hiring policies of the companies he is interested in. If they conduct extensive legal background checks, it could pose a problem.
- 👩‍💼 In the event of a job interview, your brother should be honest about the situation if asked about it. He should explain that the case is pending and he is innocent until proven guilty.

Q.3: Whether to let the case go to a full trial or compromise depends on the circumstances and the legal advice you receive. However, an acquittal might be better for his record in the long run:

- ⚖️ Consult your lawyer about the best course of action. Consider the impact on his future, the chances of winning the case, and the time it would take.
- 🔄 Remember, a compromise might be seen as an admission of guilt by some, which could potentially affect his future prospects.

Remember, this advice is based on general HR practices and laws in India. It's essential to consult a legal professional for advice tailored to your specific situation.
