We now require a separate license for this hazardous unit. I would like to understand the procedure, if any, outlined in the relevant laws that govern how this hazardous unit can be segregated from the existing license and a new license obtained. Section 4 of the Factories Act 1948 has provisions for empowering the State Government (referred to as the Chief Inspector of Factories) to declare different departments as separate factories. You will need to submit an application for this purpose and also separately submit a Factories License form for the hazardous process factory and another for the remaining factories.
Splitting of factories has certain advantages and disadvantages. You need a specified Factory Occupier and Factory Manager, must submit all forms and maintain registers separately, and pay license fees individually. The Labour department may require separate compliance for various aspects such as the canteen, ambulance, creche, Welfare Officer, Safety Officer, and Certifying Surgeon.
From my experience in dealing with this matter, it is felt that over time this process becomes cumbersome. Therefore, it is important to thoroughly weigh the pros and cons before making a decision, as splitting up is a one-way process and reversing it is a herculean task, even though there are legal provisions for it.
