I need a help regarding PF account no. not required by the employees.
If an employee who is having basic more than Rs.6500/- and he/she does not want a new PF account no. in the organization as per their willing.
Do we have any form / notification for the same?
Kindly share as its urgent.

HI,
As per PF act each and every employee are entiled for PF for minimum PF wage 6500/-, explain to the employee if he not willing to contribute from his basic salary minimum contribution will be applicable.
Or you have to break the law...

I strongly agree that if anyone is having the basic as per ceiling amount, he/she has to contribute the PF part from their salary as per law.
But is it ture that a employer can not force to the new employee for having a new PF account no. in new organization.
Kindly advise what record should be maintain for such situation.

Please clarify that employee want to continue old pf account no... if so it will not be possible, since pf account number will differe based on Employer code and location
But the employee can dtransfer so you have to get FORM 13 (Transfer of account) but will receive new number, please closely follow the process of transfer in pf office or i think now we have facility to transfer PF account from one to another through online.

Since employee has already closed his old PF ac no. and he doesn’t wanted to be a PF no. He is not willing to have new PF account no in our company.

This is not possible. if the age of employee is greater than 58 is not required if less than that not possible. or you can have the employee as consultant not as employee then it will be possible

where in the excluded employees are defined as below:-
What is meant by "excluded employee"?: "Excluded employee" means-
an employee who, having been a member of the Fund, has withdrawn the full amount of his contribution in the Fund (a) on retirement from service after attaining the age of 55 years of (b) before migration from India for permanent settlement abroad; or for taking employment abroad;
an employee whose pay at the time he is otherwise entitled to become a member of the Fund, exceeds Rs. 6500.00 per month;
a person who, according to the Certified Standing Orders, is an apprentice, or who is declared to be an apprentice by the authority specified in this behalf by the appropriate Government. {Para 2(f)}
Here it is clearly mentioned that at the time he is entitle to become a member i.e. at the time joining of organisation, he is drawing basic salary more than Rs.6,500 then obviously he has an option to join the scheme or not.
In this case you can take declaration to that extent from the employee.
