Please let me know what statutory processes need to be done when an employee is involved in an accident with major injuries. The accident may occur both inside the factory and outside the factory while being sent for factory purposes. Kindly provide detailed information. I hope to receive more feedback.

Dear Arul,

I don't think there is anything like that for accidents outside the premises. But if they have been covered for 24-hour medical insurance or group insurance policies, you have to make arrangements for that inside the factory.

If it is a reportable incident where an employee does not return to the factory for more than 48 hours, you need to:

1. Intimate the Inspector of Factories within 24 hours about the accident as the First Information Report.
2. Then you have to submit the accident investigation and corrective action report.
3. If the person is absent for more than a month, you have to submit a report every 20 days about his non-return and the status of the employee to the Inspector of Factories.
4. Use the forms and formats as per the Inspector of Factories.
5. Any reimbursements or medical expenses should be included in the reports.

Subject: Re: Employee Accident Inside the Factory Premises

Hi,

I am working in an engineering-based company as an HR executive. Our company pays the workers and all department incharges based on piece-rate wages, and there is no direct recruitment of workers. The incharges recruit the workers and are responsible for paying the wages. Last week, a person was recruited as a machine operator. After receiving one day of training, he began working. Unfortunately, while working, he had an accident at the machine level and lost his finger. He is now requesting compensation of 1 lakh rupees, as supported by local individuals.

Please note that the incharges are responsible for ESI and PF deductions for the employees, but they have not been doing so.

Kindly assist me in this matter.
