Hi all,
I'm in a position to release the list of holidays for 2008 (yeah, it's already late). I've joined this company, and there is no HR policy as such, so it will be helpful if you can guide me in preparing it. Are there any limitations, like only 12 or 14 days of holiday can be given? Please pour your suggestions earlier.
Thanks in advance,
Swati

Hi,
Manufacturing setup companies normally follow a 10-day timeline. Some companies, including some manufacturing and small corporate entities, require 12 days. For corporate procedures, the timeline extends to 14 days. Ultimately, the duration is subject to management's decision.

Hi, Swathi!
If some companies are following a certain rule and we are also required to comply with it, that is not correct.
The exact information is as follows: There is an act called "The Factories and Establishments (National Festival and Other Holidays) Act, 1974". According to this Act, the following holidays are compulsory:
1. 26th January - Republic Day
2. 1st May - May Day
3. 15th August - Independence Day
4. 2nd October - Gandhi Jayanthi
As per the above-mentioned act, the total recommended holidays are 9, including the compulsory holidays mentioned above. Besides the Act, it is at the discretion of the management to decide on the number of holidays.

Hi Swathi!
Apart from the "National Festival and Other Holidays Act, 1974," another Act is The Shops and Establishments Act. In this Act, complete holiday rules are referred to. It is the management's discretion to allow a number of holidays. As the HR person, we have to see if the minimum limit is being covered or not. Also, the Labour Commissioner will issue a notification every year at the beginning of the new year regarding the compulsory allotment of holidays. You can get a copy from them and decide how many holidays to declare.

Dear Swati,
Hopefully, you are looking for information on the laws applicable in Karnataka. For this, you will need to refer to the Karnataka Industrial Establishments (National and Festival Holidays) Act, 1963, the Karnataka Industrial Establishments (National and Festival Holidays) Rules, 1964, the Karnataka Shops & Commercial Establishment Act, 1961, and the Karnataka Shops & Commercial Establishment Rules, 1963.
As per Section 3 of the Karnataka Industrial Establishments (National and Festival Holidays) Act, 1963, the employer must provide 3 national holidays and 5 other holidays. (Bare Act attached).
In our company, we follow Haryana's state rules and the List of Leaves released by the Ministry of Personnel. (Copy attached).

Dear Swati,
First of all, Holidays = Public Holidays. State rules will have no implications as far as my knowledge goes. The state will come into the picture while deciding about the days off. The minimum number of public/national holidays is 8 as per me. However, some companies give 9 or 10. The standard practice is to give 10 public holidays. The mandatory holidays are already mentioned by one of the members, which is a must. The remaining can be decided based upon the festivals of the employees working in your organization. The detailed list of holidays can be obtained from a State Bank - (online through Google), and then the list can be adjusted accordingly.
Thanks,
Shalini
P.S. In case of any other help, feel free to get in touch with me at shalinichordia@gmail.com.

Hi all,
I'm in a position to release the list of holidays for 2013. I've joined this company, and there is no HR policy as such, so it would be helpful if you could guide me in preparing it. Are there any limitations for national festivals and other holidays as per the West Bengal Factories and Establishments Act? Please help me create an HR policy regarding festival holidays.
Thanks in advance,
