Dear All,
Can any body tell me whether an employee having completed 4 years 11 months and 15 days is eligible for gratuity under the Payment of gratuity Act. He has got 264 days continuous service during the period.

The minimum period is 5 yrs of continue services. even a day less, eligibility of gratuity does not arise. In case of shops and establishment act if applicable in your state pls check. In andhra pradesh if person works for 1 year he eligible for service compensation. the calculation is one and same for both.

Dear Member, If an employee completed 4 years plus 240 days of conituous service, he is automatically eligible for gratutity under the Gratuity Act.' Murugavel.B Chennai
