Respected sir, I won't ask if I may face difficulties in getting a new job if I sued my last employer for nonpayment of my salaries and EPF amount. How can I convince the new employer or HR? If a new employer conducts a background verification, the old employer could speak negatively about me to the new HR. How can I escape from this situation? Please guide me.

It is not your fault that your prior company did not pay your wage on time, and you have the right to sue them if you were not listened to. I also believe that the former employer would never admit to not paying staff salaries. However, the cause for your salary not being paid is due to certain missing information in your query. Was it because of a disciplinary issue? If your old employer shares the facts with your new employer, this could be a red flag.

Ideally, we should do thorough follow-ups and send a sufficient number of reminders to companies who do not respect the law. I'm not sure if you tried to bargain with your employer about this before you sued them.

For blocked EPF amounts, complain to EPF authorities, and the matter will get resolved. If EPF amount is deducted and not remitted to PF, it is a serious issue for the company. Get your papers in order and collate EPF deducted as per salary slips, etc., and the amount as per PF statements from EPFO.

Once you collect the documents, filing a complaint with EPFO is not an issue. As far as pay is concerned, filing to get your legitimate dues will not affect your verification. Of course, the previous employer will try to be negative about you at any rate. The new employer will understand that the negativity is due to the unpaid dues issue.
