Hi All, Myself Satish Mishra. I have a quarry regarding the engagement of Private Security in construction projects in INDIA. That the same will be governed under which Act.

Dear Satish,

You can engage security guards at your construction sites on contract basis through private security agencies. This arrangement would be coming under the purview of the Contract Labor (Regulation and Abolition) Act,1970. The applicability of the Act and other statutory requirements like registration, licensing etc., depends on the no of contract security guards to be engaged and the duration of the construction projects. First, you go through the provisions of the said Act and the Rules framed under it. Then, you engage the services of a labor law consultant in the locality who will guide you in the preliminary works in this regard.

You will also be under Private Security Agency Regulation Act, so you need to verify that the contractor has license issued by the Local Police Commissioner of the district.

Further, you are covered by Payment of Wages Act, Minimum Wages Act, PF, ESIC, for all of which you need to ensure that the contractor is adhering to the legal compliance requirements. You will be liable for his failure

All that you need to choose the agency which has following statutory compliance documents and records with clean management of business in terms of Quality of services and its manpower.
1)License under Private security agencies act 2005.
2)Exemptions under section 23 of Private security guards employment andwelfare act or scheme.
3)Shops and estd act license.
4)registeration under epf and esic act.
5) Registrration under LWF and PTRC
6)Gst registeration.
