Dear All, I am from Hyderabad and working for a polymers company as HR. Can anybody please help with how the wages will be calculated..
Presently, we are calculating as follows: The minimum wage is 9500 / 26 (except Sundays and public holidays).
If in a particular month working days are only 24 or 25 or 27. how the calculation has to be made... can anybody please explain with an example.

We need to understand that salary being paid on monthly basis to staff and other employees which consists of 30 days and wages are being paid to a workers on daily rate basis and which has to be arrived at by dividing gross wages by 26 irrespective of Sundays and holidays in a month.

The daily rate is to be computed by dividing monthly minimum wage by 26, irrespective of how many actual working days are there. This is stated at the end of the Minimum wage notification (check the notification for your state)
The idea for this computation is to automatically pay for the weekly off by increasing the daily rate to pro-rate for the weekly off. This working has been supported by the courts also, so you should not have a problem.
The only difference it actually makes in computation of leave without pay for those who have not worked for the full month...

The minimum wage is 9500 for 26 days working (except Sundays and public holidays) and shall remain same for working for 24,25,26 &27 days working.

Dear all,
Thank you for your valuable replies. I understood that minimum wages has to be computed by 26 days. but, actually when in a month only 24 working days are there we have to divide with 26 and has to pay full month...if not he will get less salary for 24 days calculation. I only need an answer how this has to be calculated...any terms defined ?? if yes, please can anybody explain with the examples.

Monthly Minimum wages divided by 26, we arrive at daily rate of wages as per Act. Now the question is any daily rated employee working for 24/25/27 days in different months - what will be his actual payment.
It will be multiplied the daily rate by the no. of working days.

sir,
then for an employee who is getting 9500 for 26 days ..will he get the same for 24 working days also.....if he is getting less... will an employee accepts.....

Dear colleague,
You divide minimum rate of wages by 26 days as a standard to only arrive at the daily ' rate 'of wages.
What each worker will get actually paid will vary with the number of working days in a given month as well as days he actually worked and on authorised leave. In this situation in some months actual wages paid for will be less than the standard rate of wages calculated for 26 days which is quite alright and legal.
The confusion arises when it is assumed that standard daily rate is to be applied for 26 days every month irrespective of less number of working days.

Thanks Mr. Vinayk Nagarkar for proper clarification. I would like to add the followings for further clarification :-
1. Wage rate may be hourly, daily or monthly.
2. If wage rate is daily , the monthly minimum wages should be divided by 26 and to be multiplied by actual no. of days worked during the month for payment.
3. If the wage rate is hourly , the monthly minimum wages should be divided by ( 26 x 8 = 208 ). The payment has to be made on the basis of actual hours of work done in the month by the hourly rate.
4. If the wage rate is monthly, irrespective of number of days in a month, the monthly minimum wages should be paid.
