I just want to know if the current company extends my notice period to 3 days due to some leave reason and the new company wants me to join earlier like before 3 days. That was earlier last working date. What will happen? It will arise questions in the future.

While switching jobs, every employee should be very thoughtful about the processes of separation from the present employer and joining the prospective employer. Here, I intentionally use the term 'employer' in stead of employment or job because one may not like your leaving and try to delay it as long as possible while the other may have an urgency to hire you without any loss of time and insist on your joining as soon as possible. Therefore, the notice clause in the contract of the present employment pertaining to resignation and the time line fixed in the offer for the prospective job should be taken into active consideration in a 360 degree perspective before hand by the person intending to switch jobs. Simply put, such an employee should be prepared to serve the entire notice period to make the separation peaceful and obtain sufficient joining time to report for the new job inclusive of the time required for F&F settlement of dues with the current organization and for relocation as well to make the joining comfortable. If this point is missed due to the urge of changing jobs forthwith, such a bottleneck like the one mentioned in the post is bound to occur only.

If you choose to join the new job without formally relieved from the present organization, first it may lead to disciplinary action by the current employer on the misconduct of abscondence and your consequential dismissal that would affect your career in future.

Second, the prospective employer may insist on a formal relieving order and refuse to allow you to join.

Thirdly, if he allows, it will lead to dual employment and affect your future career.

Therefore, the poster should serve the additional 3 days in the present job and get relieved formally by obtaining prior permission from the prospective employer OR try to persuade the present employer to adjust the 3 days against his EL at credit or to permit to buy it out.

It is always better to avoid availing any kind of leave during notice period other than on urgent and unavoidable medical grounds. In addition, the exiting employee should work more diligently to complete all his pending and present duties without giving room for unnecessary criticism. He should also train his substitute properly if so instructed and hand over all his charges including properties of the organization , if any as authorised.

The day company relived you from the services to be considered as last working day. Every company/establishments considered the last working day as per the terms and conditions mentioned at the time of appointment (notice of 30/60/90 days or settled by notice period buy out option).
Therefore, you considered your joining after the date of relive from the first employer or otherwise you would invite problem of double employment.
