Private limited company with less than 5 employees. Are minimum wages applicable? Also what about ESI and PF? Please let me know what are the things I should take care of in terms of HR.

Dear Friend,

It seems you have taken charge of HR in a Private Limited company with less than 5 employees and you want to know which labor laws are applicable to you. You are a beginner.

Labor Laws applicable to you are:

1. Shops & Estb Act,
2. Payment of Wages Act,
3. Minimum Wage Act,
4. Labor Welfare Act (Refer to your State Law),
5. Professional Tax

You need to maintain the following registers and notices:

1. Muster roll,
2. Wage register,
3. Salary slips,
4. Leave Book/Card,
5. Notice of working hours, weekly offs, rates of minimum wages, date of payment, person responsible for payment of wages, etc.,
6. ID card for all employees

You need to maintain personal files of the employees with their basic details such as employment form with proof, photo, appointment letter, etc. Read and understand the above applicable laws with rules that apply to your State. Additionally, familiarize yourself with the Industrial Dispute Act.

PF and ESI Act are not applicable to you right now. However, you still need to read and understand all labor laws. Understand the features of all labor enactments. Acquire basic knowledge of HR functioning.

Dear Friend,

I read your title now. You are asking for a salary slip structure. I divide the salary slip into 6 parts. They are:

1. Employee master information including rates of salary components
2. Days payable i.e. work days, offs/holidays, leaves
3. Earning components with the total of it
4. Deduction components with the total of it
5. Net payment
6. Proof of payment with revenue stamp.

This you will not find in any of the books or in links. During this pandemic, I am at home idle and therefore can afford to spend this much time on this forum for the last 3 months. However, from tomorrow onwards, I have decided to start my office. Once I start my office, I won't be in a position to spend any time on this forum.

Yes, you need to maintain personal files of the employees with their basic details such as medical records, attendance records, payroll (PF, ESI, etc.), employment form with proof, photo, appointment letter, etc.
