Absconded Employees - What action can an employer take?

Hi All, Can you please suggest what actions can be taken for employees who are absconding without any information? Location: Chennai, India Could you suggest what the laws of the land state, if any, on this? Thanks.

Hi,

If an employee absconds from duty without any information, please follow the disciplinary process and then issue a termination letter for absconding from duty, which will be the maximum action the employer can initiate.

However, if an employee absconds from duty after indulging in misappropriation of funds/theft, the employer has the right to lodge a police complaint as well.

hi, Send a registered letter asking to report for duty asap asking else will take necessary disciplinary action including the suspension. Good luck

HR cannot sue you or file a court case unless you have stolen some information/data or intellectual property that is not to be shared in the public domain (remember you signed a contract/bond).

Actions can be taken as follows:

Step 1 - HR will try to reach out to you on your phone numbers (cell, landline, family members' phone numbers, any emergency contacts you have shared during joining). This follow-up can be done for various durations - days to weeks (normally not more than 2 weeks). Along with this, various emails will be sent to you on your personal email ID. HR will also talk to your friends in the office, colleagues, etc. (investigation!); you will become a center of gossip in the office for a few days 😛

Step 2 - In case HR is unable to catch hold of you through any of the above, you will be declared as absconding in company records, and your employment will be terminated with immediate effect.

Step 3 - You will not be provided with any relieving letter/email, your salary from the date of absconding (depending on where it falls in the pay cycle) will not be processed, no full & final settlement will be provided. All your access will be canceled (including the removal of access on your laptop from the company server, VPN, etc., in case you have taken the laptop with you).

Step 4 - In case the company is using tools like SAP, etc., they can share the same information with other companies, and you can be blacklisted in the market. HRs do share information across the industry, especially in MNCs. The next company can easily find out your past actions accordingly unless you are starting your own business, of course!

P.S. - Absconding is highly unethical and should be avoided, as it causes a lot of pain to the HR team and the company who have invested and trusted in you.
