Please confirm if the company can deduct Gratuity from Gross Salary. Can the Basic of any employee be decreased in the increment cycle? Employee basic has been decreased after appraisal.

Gratuity, being a one-time lump sum terminal benefit solely provided by the employer, requires no contribution, either periodical or otherwise, from the employee.
I think that the action by the employer goes against the very logic of the concept of an increment. Increment means a marginal increase. So, during an increment cycle, the salary should be increased or remain the same at the next step but cannot be reduced due to poor performance.
Reduction in the basic salary consequent to an appraisal is punitive, which would be illegal in the absence of formal disciplinary proceedings preceding it.

I seek guidance regarding my situation where I have joined the organization two times, and my EPF account has been settled. However, the organization failed to generate my third account number, even though my UAN remains the same. Currently, my EPF contributions are being deposited into my settled account. My date of joining was from 01/07/2017 to 01/06/2019, but my current date of joining is not reflecting in my portal or the employer's portal. The previous date of joining is still showing there. I have tried updating my current date of leaving to 01/06/2019, but the organization claims that my case has been settled.
I am concerned about my two years' contributions for the current period not being accounted for. Could you please guide me on how I can retrieve my contributions from EPFO for the past two years?

If an employee dies before reaching superannuation, is gratuity applicable up to their superannuation age, or is gratuity applicable only for the length of their service? This is in the scenario where the company has insurance with LIC.

Strictly speaking, as per the provisions of the Payment of Gratuity Act, 1972, gratuity is payable only for the period of service actually rendered as of the date of death of the employee. Under any normal insurance policy covering the employer's liability to pay gratuity in such a case, the amount of gratuity would be the same. However, there is a special gratuity insurance policy with a life cover for the employee at a higher rate of premium. In this policy, in the event of death before superannuation, the employee would receive the amount of gratuity as if they had served up to the age of superannuation, but for the unfortunate event of death.
