I need help with your suggestions or comments on the following grievance:

I had worked in a PSU on a permanent role with the company, but the company (PSU) was closed by the government, and all the employees were given VRS and separated from the company. Now, it has been a year, and I have cleared an interview with another PSU for a Fixed Tenure Period (2 Years) at a regular pay scale.

The PSU where I have been selected demands that I surrender the VRS amount due to guidelines that state, "Once an employee opts for VRS and then gains employment in another PSU, they have to surrender the VRS amount before joining."

However, my employment is under a Fixed Tenure Basis with the other PSU. So, is the refund of the VRS Compensation applicable?

Better upload the particular clause in the VR Scheme of the closed P.S.U for our perusal.

The condition of refund after VRS is completely illegal and violation of fundamental rights. There are a number of judgments to support this view. Please see the attachments.
