I want to know whether I will be applicable for gratuity or not. My company changed its name 2 years back, so will I be eligible for gratuity? Who can help me to get gratuity legally? Since the company has denied past employees who have worked more than 5 years. What all documents are needed to submit for the legal process?

Five years of continuous service are the eligibility requirement for Gratuity. Even if your employer changes the company name for Gratuity purposes, they should consider old employees' service as continuity of service. However, if there is a break in service between employments at two companies with a new employee number and PF number, the employer can openly deny gratuity.

The change in company name does not affect your eligibility for gratuity, provided you have worked for 5 years. Please take your appointment letter, salary slip, PF statement from the 1st month of your service, and approach the Labor Authorities in the area where your company office is located. They will further guide you on how to file the complaint with them, and then they will call the employer for further discussions.

Hi Changes in the company name will never ever affect your eligibility for gratuity, upon completion of 5 years you may make an application for gratuity if you would like to exit. Regards Manimaran

While transitioning from the old to the new company, whether the company has sent any letters to you, please provide details so that the members can guide you accordingly. As mentioned by Shri Laxminarayanan, if the company has issued a new appointment with a new PF Account, you may not be able to prove that you have been with the same company for a period of 5 years or more.
