Dear Sir,

I am from Vadakara, Kozhikode. I am currently working in a service center of Royal XXX. Approximately 50 staff members are employed in this service center. However, none of them have PF, and only 10 staff members are enrolled in ESI. The company does not provide a salary description or appointment letters. I have been with the company for 3 years and still continue to work there. There is no HR manager, and consequently, there are no HR policies in place.

I am curious to understand whether the company is not obligated to provide appointment letters, salary descriptions, PF, and ESI benefits to the employees. What actions can I take against the company for exploiting my situation over the past 3 years since joining?

Every employer is bound to comply with the provisions of all the labor laws applicable to their establishment. If they wantonly fail to do so, it implies that they have some hidden agenda to deprive their employees of their long-term employment rights and benefits for obvious reasons. It is better to make a detailed complaint to the State Labor Commissioner and the Regional P.F. Commissioner. In order to avoid any retaliatory action by the employer, claim anonymity or let the complaint be made by any popular Trade Union Federation.
