Dear Seniors,
One of my friends worked at Manappuram Finance Limited a few years back, and he resigned from there. After 9 years, he received a lawyer's notice/letter from Manappuram Finance Limited. At the time of joining, an agreement was executed between him and the company, stating that he has to pay an amount of Rs 6000 with an interest rate of 24% added for the 9 years. They claimed that an employment loss had occurred, but at the time of his resignation, they did not mention anything.
What should he do? Please help him resolve this issue.

Hi,
Please provide clear details so that members can respond without going back and forth. Did you resign after serving the notice or abscond? What kind of agreement did you enter with the company at the time of joining? If you have completed the handover as per the employment letter, there shouldn't be an issue.
Moreover, under the Law of Limitation, the issue is not maintainable in court as it has exceeded the allowed period.
However, if you have missed mentioning any other issues in between, please do so.
Thanks and Regards

The Law of Limitation goes clearly against any such claim, provided the party has not been raising any letter or claim in the meanwhile.

Hi Seniors,
My friend resigned from his job immediately by sending a resignation letter via email to the Head office, without serving the notice period. All handover tasks were completed on the same day. However, he is unaware of the contents of the agreement paper signed during his joining, as it was a long time ago and he does not have a copy of the agreement.
Thank you.

From India,
I have joined the company in Nov 2018 and signed an undertaking for 2 years of service. The notice period was 3 months. Due to my family problems, I left the job on 14 Jan 2019 and sent a resignation letter without serving the notice period. I have not received the salary for Jan and some days of Nov. I only accepted the offer letter through email and did not sign the appointment letter due to some unwanted conditions. As I left the job without serving the notice period, the company sent me a notice of loss. They are claiming one lakh against economic loss due to the sudden resignation from the job. My salary as per the offer letter was 37,000 per month. Please guide me, is it legally okay? What should I do now? I am not working after resignation and am unemployed. I sent an email regarding my poor family condition and the reason for immediate resignation. The reason is my grandmother died, and my mother is sick. My family needs me to take care of them. So, I am with my family in my hometown and not working anywhere. I am not in a position to cover their loss of one lakh. I worked from 28 Nov 18 to 13 Jan 19 and only received the December 18 salary. The company has not paid the remaining amount. As per the undertaking I signed during joining, if I leave the company, I have to serve a 3-month notice period. The second condition is that I will not offer my services to any competition for 36 months after leaving the present company. The third condition is that if I violate these conditions, the company will claim appropriate economic loss. Kindly suggest legal advice on what I should do.
