Hi, I wanted to know what are the Paternity leave Pay Benefits for IT companies in Maharashtra. My HR says that mark the leaves as general leaves instead of paternity. For maternity the full salary is given to the employee. What is the rule as per Govt. Of India?

Paternity leave is depend on the organization profile, but as per legal their is no legislation for paternity leave for private sector employees, if an employee belongs to govt sector either state or central, 15 days of paternity leave will given these can be used before or after the delivery, if they don't use those leaves, those can be lapse, but all 15 days are paid leaves.
but normally private companies, they give paternity leave of min 3 to max 5 days.
