Hi, I wanted to know what the Paternity leave pay benefits are for IT companies in Maharashtra. My HR says to mark the leaves as general leaves instead of paternity. For maternity, the full salary is given to the employee. What is the rule as per the Government of India?

Paternity leave depends on the organization's profile. However, there is no legislation for paternity leave for private sector employees. If an employee belongs to the government sector, either state or central, 15 days of paternity leave will be given. These can be used before or after the delivery. If they don't use those leaves, they can lapse, but all 15 days are paid leaves.
Normally, private companies give paternity leave of a minimum of 3 to a maximum of 5 days.
