One of my colleagues was blessed with a baby boy. He now has 3 children. He took paternity leave twice in the past. However, the HR department has denied paternity leave for the 3rd baby, stating that he had already taken leave twice before. They mentioned that they can grant leave for up to twice, but not more than that.

What can we do for him in this situation? Are there specific rules regarding paternity leave that you could share?

No gentleman. Better to use CL or SL or earned/privilage leaves.

As far my knowledge goes that 'Paternity leave' is not in vogue ( in practice ) in India.

There is no such act that extends benefits to fathers for their child's birth. If any organization is providing a facility, it is governed by the policies of the establishment.

Our government adheres to a two-child norm; therefore, it is understandable for your HR to deny extending the facility for the birth of a third child.

Dear Mr. Chauhan,

Please check the policy of granting paternity leave by the company to its male employees. It seems that according to its policy, it can be granted not more than two times during the service tenure.

Wish you luck.
