In our company some of the employees are sending resignation letter through Mail & they are not serving the notice period because as per our apportionment letter they have to serve the 6 months’ notice period & 3 years agreement, if they give resignation letter in hard copy then our director will scold and tease in front of everybody. So in this case what action we have to take against to them.

Dear Santosh,

There is nothing mentioned in the law about the notice period. It states that if an employee resigns, he/she should give proper handover and obtain clearance; however, there is no specific notice period that has to be given.

The practice you have adopted is akin to forced labor, which goes against my policy. It would be better to change your policy and implement it in accordance with legal laws.
