I need your valuable suggestion for my previous organisation employment. I served for 11 months there and left Job for better opportunity in same field.
I had not received confirmation letter or acknowledgement from company on completion of probation period which is 6 months there. I served notice period of 35 days thinking I was not confirmed where I suppose to serve 90 days notice as per appointment letter after completing probation. During my resignation time, neither my line manager nor HR discussed on notice pay. In my Full & Final settlement deducted notice pay. When I had asked HR for deduction even for not being confirmed employee, they replied saying that as per company terms you have availed increment in March 2018 which will be given to confirmed employees so assumed as completed probation.
Company follows issuing confirmation and getting acknowledge for it. Here my question is if they had discussed on notice pay before, I was open to serve notice or would have asked to buy from new Employer.

All your choices now expressed are all in hindsight. Serving notice period now has no place. Many firms are not prompt in declaring 'completion (or extension of) of probation'. A sound HR office practice call for proper communication and keeping records straight instead of keeping the staff guessing and presuming. In your case also they insisted that 'granting increment is as good as completion of probation & confirmation'. And about NP, you should have thought it before hand when you decided to quit. Had this vision alerted you in time this question now known would have been answered in no uncertain terms. You missed the bus in time, and thus you'll have no choice. That apart, 90 days NP is abnormal. I think you had not signed any bond, if yes, that much you are saved. And for now, just try by sending a request explaining your view point and see what happens. If you are going to be favoured you are fortunate. If not, leave it as bad luck. Not worthy to take it up legally.
