108. Display of Notices

(1) In addition to the notices required to be displayed in any factory by or under this Act, there shall be displayed in every factory a notice containing such abstracts of this Act and of the rules made thereunder as may be prescribed, and also the name and address of the Inspector and the certifying surgeon.

(2) All notices required by or under this Act to be displayed in a factory shall be in English and in a language understood by the majority of the workers in the factory. The notices shall be displayed at some conspicuous and convenient place at or near the main entrance to the factory and shall be maintained in a clean and legible condition.

(3) The Chief Inspector may, by order in writing served on the manager of any factory, require that there shall be displayed in the factory any other notice or poster relating to the health, safety, or welfare of the workers in the factory.

Refer rule 98 and section 61 of the Factories Act as well.

The contractor's license is the property of the contractor and not of the establishment in which its contract labor is deployed. The establishment can and should keep a copy of the contractor's license, but it need not be the original. The idea is impractical as the contractor could be deploying its workforce in more than one establishment, then where will the license be displayed. The contractor could display it in its establishment.

Dr. Mr. Ramamoorthy,

The cement industry is declared as a Controlled Industry as per the Industries (Development) Act. Therefore, under the Industrial Disputes Act and the Contract Labour (R&A) Act, the Central Government is the appropriate authority.

1. As a Principal Employer, every cement factory needs to register under the Contract Labour (R&A) Act if 20 or more contract labors have been engaged through any number of contractors.
2. The Principal Employer has to maintain a Register of Contractors in Form XII.
3. The Registration Certificate must be amended whenever there is a change in the contractor or the number of contract labors of any contractor.
4. Display a notice board as per Rule 81(1)(i) of the CL (R&A) Central Rules, 1971, showing working hours, weekly holidays, wage period, rate of wages, date of wage payment, date of unpaid wage payment, and the name and address of the inspectors, i.e., Dy. Chief Labor Commissioner, Regional Labor Commissioner, Assistant Labor Commissioner, Labor Enforcement Officer.
5. A copy of the notice displayed under Rule 81(1)(i) must be sent to the Inspector as mentioned above.
6. Display an Abstract of the CL (R&A) Act 1970 and the Central Rules, 1971.
7. Submit a notice of commencement/completion of contract work within 15 days for each contract work to the Inspectors in Form VI-B.
8. Issue Form V (Now Form III) to contractors who have more than 20 contract labors for obtaining a license.
9. Submit the Annual Return online before the 15th of February. Witness payment by an authorized representative and record a certificate on the Wage Register of the contractor, stating, "Certified that the amount shown in Col... has been paid to the workman concerned in my presence." Payments are currently made through banks; you can confirm payments by reviewing bank statements of the workers.
10. Additionally, check the payment of PF, ESIC, and PT by examining challans and ECR. Also, ensure no unauthorized deductions have been made by the contractor from the workers to match the minimum wages on paper, such as advances or uniform allowances.

By implementing these measures in your establishment, you can avoid any prosecution under the CL (R&A) Act.
