An employee, after 5-10 years of joining as a probationer, proceeded on leave after submitting a prescription slip from the Medical Officer. Almost 2 years have passed, but the employee has not rejoined her duty. She also got married during this period and is currently settled in a foreign country. Several notices have been sent to the address provided in her record, and a notice has also been published in the newspaper.

Please provide/suggest the rules to terminate her services.



For how many years you are going to wait for her? Now why is the need to terminate her services?

Even I want to know why you guys are waiting for her till date and after 5-10... of what, 5-10 days or 5-10 weeks, please clarify.

My suggestion is to mention in your terms of employment that an employee who is absent from work for more than 5/6 consecutive days without notifying their manager or HR will be considered as voluntarily terminated from their employment. Excessive absences, tardiness, or instances of leaving early are grounds for discipline, up to and including termination.

Many times it happens with employees, especially freshers, that they join the company and leave within 1 or 2 weeks without notification. So, we also have to move on as the employee moves on.

I would like to know on which position she was working and if there was any confidential information shared with her that is still a concern for your organization till date.
