Today, I lost my job with my USA multinational company Tranzact, who inducted me on 1st of June for the Bhopal location as GM (Operations) and asked me to apply for a US Visa and come for training in the USA for 3 weeks. However, my US Visa was rejected thrice by the consulate just on assumption and flimsy grounds, despite my case being highly genuine. I have not committed any crime or offense throughout my life, nor has any member of my family. My academic and professional background is impeccable without any dark spots.
I recently got a job in a US MNC for their office in Bhopal (MP) and received the offer letter on 1st June 2018. The company asked me to come to Illinois for 3 weeks of training. My permanent position is in Bhopal only. I applied for the visa for the first time from New Delhi with an interview date of 24th July, which was refused under 214(b). I then tried from the Kolkata location (as I could get an earlier appointment), and my interview was on 02nd August, but it was again refused citing reason 214(b) for not qualifying due to being newly joined in the company and questioned how they were providing me with training in the US for three weeks. I applied again on 10th September from Kolkata, and once more, the consular refused my visa for the same reason under the same section without fully verifying my documents.
I am a Mechanical Engineer from NIT, Bhopal, with a Post Graduate Diploma in Financial Management and a Masters in Computer-Aided Design, with 20 years of experience in leading companies like Godrej and Boyce, Indian Railways, IFB Industries, Bajaj Auto Limited, etc. Why am I being denied my deserving opportunity by the visa consulars who do not even review the documents thoroughly and simply state that I do not qualify because this is a new job? I have joined in a senior position in the company, so this is truly shocking for me. It is severely affecting my job prospects as this training is mandatory for keeping my job secure. I am already 45 years old, and you know how challenging it is to secure a job nowadays. What is my fault in this, as their reason for rejection is not justified and solely based on assumption and prejudice?
All the tickets and lodging for boarding during the training are being arranged by the company, and I am settled in Bhopal with a strong family and professional background. This is a case of a proud Indian being selected in a good company based on their own credentials but being denied the job prospect and training solely on the assumption that they might be an immigrant, which is on flimsy grounds. This situation has left me unemployed, and my family will suffer greatly.
My parents are also senior citizens, and I look up to them. This job is the only source of income for me. Therefore, I kindly request you to consider my case on humanitarian grounds.

There is nothing you can do legally. All you need to do is write a letter to them, clarify your position, and hope they understand.

The US Consulate cannot decide on your suitability for the job. Your credentials were accepted by Tranzact, and the US Consulate cannot veto the same. Perhaps, you could request Tranzact to exert its influence in getting your clearance. Maybe you could try the tourist visa.

Where a tourist visa can solve the issue, because a tourist visa is available for 30 to 90 days, and the training is only 3 weeks, you have taken the improper steps to obtain the visa. For a work visa, a significant amount of documentation is required, and it needs to be approved by the USA-based permit issuing councilor. This process is something the applicant cannot influence; it is solely the responsibility of the employer to handle it.
