I am working in a construction company, and my salary is more than Rs. 15,000 per month. I asked them to deduct PF from my salary. I have a UAN number from my previous employer, but they refused and said that since my salary is more than Rs. 15,000 per month, we cannot deduct PF.

If you are a PF member before joining your present company, and your present company is covered and registered with PF, then it is compulsory for them to deduct PF from your salary. There is no option available for the company not to deduct PF.

I have one question: if the salary is more than Rs. 15,000, does that make the deduction of PF optional? What about ESI deduction? Is the company required to comply with the ESI deduction for a gross salary of Rs. 21,000, or is that also optional if the company is providing other medical benefits to their employees?

Dear Mr. Akash,

PF Coverage is based on the information provided in Form No. 11. A PF covered employee continues to be a PF member even after changing jobs, provided he has not withdrawn previous PF accumulations. If he has withdrawn PF accumulations and joins a new establishment, he can be excluded from coverage provided his basic and DA are more than Rs. 15,000/-. EPF is one of the beneficial legislations enacted for the purpose of creating a retirement fund.

Present ESI coverage is Rs. 21,000/- per month (GROSS SALARY). Consequently, all employees drawing a gross salary of Rs. 21,000/- and below are compulsorily covered under the act. It is not optional. Once they cross the wage ceiling, they become excluded employees. Consequently, contributions need not be remitted. They have to be covered under the company medical scheme.

handover the form 11 to employer filling all colums and mentioning the UAN, employer has no option to refuse the employee who already has an active UAN from past working establishment
