I paid a 50000 security fee before joining the company (aviation sector) due to personal reasons. I left the company within 6 months. Now, the company is asking me to give them 40000 as full and final settlement; otherwise, they will take legal action against me. What will happen if I don't submit this amount to the company?

To take legal action, there has to be a valid commitment from your part to pay the amount in case the service is abandoned. Did you sign any contract of appointment providing for it, or was it a part of the appointment terms, or was there any other commitment to serve for a minimum period? Please check.
To ask for any such amount, did they train you? Legal action can be threatened very easily, but when it comes to the real court battle, there are many slips between the cup and the lip!!!

hey kk!HR i did sign a contract" Company will be subject to termination with
one month’s notice by the Company or payment in lieu thereof"
I have taken complete training from them as well. I don't need any experience letter from them so if i don't want to pay the F&F amount will it a big problem for me ?

Did you honor the commitment to give one month's notice or make payment in lieu thereof? What was the duration of the 'complete training' undergone by you? Obviously, the Company would have invested time, efforts, and money to train you. Did you reciprocate by giving commensurate services in return? Apparently, you have not done it. And now you are seeking the help of HR professionals to find an escape route. Great attitude! Congratulations!

I think the members should not give any advice or entertain posts that provide incomplete information. In most cases, we find that employees are being unjust to employers. Until they are unemployed, organizations are like gods to them. Once they secure employment and gain some experience, they forget all the efforts, training, facilities, and opportunities the companies have provided to them and start comparing themselves with their seniors. After gaining 6 months to 1 year of experience, they feel they are equivalent to the GM of the organization. Loyalty, sincerity, and integrity are not in their dictionary, but they expect free advice from HR forums. If a company terminates such individuals, the company is seen as at fault. However, when they leave without notice or intimation, they still expect the company to treat them fairly and cooperate.

Dear anonymous,
I am unable to agree with you. At any rate, there is an ethical and moral dimension. Are you ready to sell your integrity for Rs. 40,000 after committing yourself? The extent of legal action the employer can take cannot be surmised, though it will likely result in a long-drawn battle. However, your suggestion to avoid the commitment is not endorsed.

Dear Alisha,
Would you tell why you paid 50,000 bucks against what kind of security for joining the company? Whether the amount of security is refundable?
When seeking advice from the forum on any legal matter, always provide complete information so that the learned members of the forum can advise you in a justified manner. Your information does not have head or tail, but expectations as to your wish.
No one can say anything good without verifying your appointment letter and the service contract you signed with the establishment. If you are serious about the matter, either post the document or seek help from a lawyer who deals with HR and contract-related matters. Now you have to make a decision.
