Seeking advice on a recent issue I am facing. An employee has just returned to work after maternity leave and has resigned from the job, stating that it is difficult to manage a job and a newborn baby at the same time. As per law, should she be relieved from duties as per the normal process, or is she liable to pay back the monetary benefits that she has received (in terms of salary) during the maternity leave?

Dear Anubhuti ji,

Maternity leave is a right of women, and accordingly, she availed it. After availing the leave, she resumed her duty and resigned. Then, where is the question of paying back the benefit availed? Mr. Sivaramakrishnan answered you rightly.
