I have joined a company recently. It's conduct surveys of Roads, Bridge etc. through Total Station Machine. Company was providing Sundays as holiday till now, but an agreement if being prepared in which it is stated that the company will provide only three holiday in a month instead of Four. I want to know that can an Employer is eligible to reduce holiday in this way and is it legal or illegal. And what can an employee do in this matter. Please guide..

Weekly off itself has a meaning, off after a week. Every factory, establishment and or organisation are bound to provide weekly off to its employees/workers after working 6 days in a week.

Your company can no way reduce weekly off days as it appears in a month. Any working on holidays attracts payment in doubled the rate and a substituted leave as the case may be as per the rules of the state regulating national & festival holidays.

Dear colleague,
It is mandatory to give a day's off after 6 days' work. You have no powers to reduce the number of weekly off and if you do it will be blatant violation of law and liable for punishment as provided.

Dear Friend,
1. It is a service condition as well as regulatory compulsion on the employer to give weekly off after every 6 working days as mentioned by other members above.
2. Under Indian Factories Act and Shops & Establishments Act it is mandatory to give weekly offs as above.
3. I presume that your Company is registered under Shop Act. Please read the provisions of Shop Act of your state and you will come to know.
4. In case due to exigencies of work if employer is unable to give the off then the employee has to be given compensatory off. For Comp off also the conditions have been mentioned in the Shop Act. The Act also mentions the punishment to employer for violation.
