Good evening all,

Is an outsourced woman eligible for the MB Act 2017? I was recruited by a third-party government organization through consultancy and worked in a government-based service sector for 140 days. Now, my company says I am outsourced by a third party, so I am not applicable as our system is "No work, no pay."

Kindly guide me, please.

Dear Anitha, You need to ask your immediate employer/Contractor. He has to approach the Principal employer.

I approached my company, and they said I am not applicable for that and rejected my request. They mentioned that they won't provide Maternity Benefit to any women because they replace them with new candidates to complete the work. They emphasized that I am not eligible. I kindly request suggestions on whether I am eligible for the Maternity Benefit under the Maternity Benefit Act 2017. Should I appeal to the labor court?

You are eligible. You send your application with medical doct to your immidiate employer and copy to principal employer as well sent a copy to local labour office your working establishment.
