Hello All,
We would like to know the benefits if an employee got into an accident in the middle of the journey from the Hotel to the Office.
1. The Manager/Head forcefully sent me to the office.
2. The Manager is making threats, like if you do not join the night shift, we will fire you.
3. The Manager said to do the night shift according to the company's demands.
4. Due to night shift jobs, I had an accident, and my right hand got fractured.
5. The doctor said it is temporarily disabled for my right hand as the movement is restricted.
6. The employer is not taking any responsibility, and due to my injury, they are attempting to terminate me. If they terminate me, survival will be very difficult for me as I have a family with kids.
7. They are sending me onsite (customer location) at night when I requested the employer managers not to, but they are not listening and insist I must work night shifts due to customer demand.
8. My injured hand had a lot of pain during the night.
9. My physiotherapy is ongoing, and I am spending a lot of money on it, but the hand movement is still restricted, and I am becoming more depressed each day.
10. Nobody is listening to me.
Kindly suggest what actions I can take against my employer and managers because they are treating me like a robot.
What laws can be applied for temporary disablement?
How much compensation can I claim for temporary disablement?

Were you in a hotel or on office duty? Did you meet with the accident during the normal time it takes to reach the office? Are you covered under ESIC? What is the nature of your job? Have you written to the company about the accident, narrating the circumstances and attaching the medical certificate?
