Dear Amit,
The employer is supposed to pay bonus to his employees if their salary or wages consists of basic plus DA doesn't exced 21K per month. Thus you will be eligible to draw bonus even if your gross salary exceeds 21k per month.

Dear All,
Here i would like to clear you that, according to Bonus act Amit is not eligible to get bonus, wages ceiling limit for bonus is based on Gross instead of Basic + DA. If your Gross salary is above 21K on 31st March 2016 means you are not eligible to get Bonus. On other hand If your Gross salary is below 21K on 31st March 2016 means you are eligible to get Bonus (According to Bonus Act).
NOTE : Do not follow present salary for the same (Oct - November)
Now, its depend on employer whether he wanna give to you or not but employee cannot force him.

Dear All,
It is not clear what do you mean by 'gross' salary. Allowances are excluded but any payment not qualified as allowance shall be added. If Basic + DA+unqualified allowance exceed 21K, you are not eligible otherwise you are eligible upto a ceiling of 7K.

Sandeep sir has pointed out differently according to him gross salary should not be exceed 21K as on 31/3/2016. Still i am confused
weather i am eligible for bonus or not because of having different views given by seniors........

If your gross salary (Basic + DA + Other Allowance) exceed 21k upto 31st March 2016 means your not eligible. On Other scenario gross salary below 21k upto 31st March 2016 means you are eligible to get bonus on this coming Diwali (Oct-16).

Hi, I have a related query,One of our client company says they are startup company and not completed 5 years,hence they are not eligible for paying Bonus to contract employees working at their premises.Request the respected members to pls clarify this doubt?Any relevant notification or guideline if any Pls share.Thanks
