Dear All,

I recently signed a bond with a company. The bond states that I cannot apply to any institute or company while working here. If I wish to do so, I must give one month's notice to them and then apply during that notice period. I want to take the CAT exam this year. How can I deal with this? Also, I have no other option but to take the job as I have not received any offers for many months, and my gap period is increasing.

Please help.

Thanks

The bond is not applicable to CAT anyway. No bond can stop anyone from acquiring higher skills in his/her field of choice. Kindly put up the wordings of the bond for other learned members to advice.

Hi,

Thanks, sir, but the problem is, after taking the CAT exam, I must apply to institutes promptly as the best ones have deadlines. Without admission confirmation, how can I resign from my current job or inform them that I am applying to XYZ Institute and consider it as my notice period? I am also concerned that if I pay the bond amount and resign, I may not receive my experience/relieving letter. I do not have the exact terms of the bond currently, but my HR clearly stated that I cannot apply anywhere without providing a notice period, as I inquired before signing the bond. Please advise.

Thank you.

The bond is illegal since it is a violation of fundamental rights and such bonds have been declared illegal by various courts

Dear sir,

You have already signed the bond and subsequently decided to appear in CAT and do all those things required for admission with full knowledge that the terms of the said bond are applicable. Yes, the employer will certainly sue you for bond money and damages.

The employer, whatever his standing, needs to abide by the Laws of the Land. They have no licence to dictate like a Khap organisation.
