Hi All, I have joined a multinational company 2 months back and I am resigning from this organization due to personal family reasons.
My HR is asking me to complete the notice period of 2 months. I was assuming, the Notice period is not applicable in the probation period.

There are no specific Labour Law that an Employee is supposed to give a notice period if he is in probation period. It depends upon an agreement / appointment letter signed by both Employee & Employer. If its mentioned in such agreement / appointment letter employee has to give notice period otherwise its not necessary.

It is observed that some of the IT Employees, Software & Hardware quit the jobs (which they got after great hunting etc.,) within a very short span of time; even before reading/understanding the Appointment Order T&C which they have recd and acknowledged after signing. They are not realising that Cos. are not stop-gap centres to come & go without proper compliance.
They should also realise how the HR Dept. can cope with this type of attitude of throwing all Rules & Regulations of the Co. to the wind when they chose to quit suddenly without giving time for Recruiting replacement. Some employees have started going to Court to settle the issue of Notice Period & the litigation causes problems for all; apart from the charges, Time & energy of Co.HR, concerned employee, Court, Lawyer etc.,
It is necessary that Cos. should stipulate reasonable Notice Period & educate / train employees on Apptt & other Employment T&C to reduce heart-burning, embarassment & litigation.
