Hi, I was working with a Travel Based BPO company in Gurgaon at the position of Travel Sales Consultant for the last 2 years. Due to a sudden decline in my husband's health (for which I have relevant proof as he is suffering from a major communicable disease), I was not able to focus on my job. My presence was required at home, and I thought to resign. However, the company had the guidelines of serving the notice period of one month, which I couldn't do because the circumstances were not favorable enough. My husband and I live on our own in Delhi, and I resigned through email. My team leader was well aware of the situation when I had been going for doctor appointments. However, I didn't get any reply from my Team Leader on the resignation email, which was supposed to be sent across to the HR Department. I then marked an email to HR after 3 days, but again, I didn't get any reply. I followed up with them over email after 3 days. Later, after 2 days, I received a reply stating that they were not aware of my situation. Since I didn't serve the notice period, they wouldn't proceed with my FNF formalities, and my status in their records was marked as absconding. Upon checking this email, I immediately went to my office to speak with the HR people. The head of the HR department was blunt. Even after explaining my situation with all the doctor's prescriptions and test reports, he straightaway said they wouldn't provide me with the relieving letter or clear my dues (which include my January month incentive and February too). Instead, he asked if I could pay them half of my salary amount, then only he would provide me the relieving letter without clearing any of my dues. That made me shattered, seeing the insensitive attitude of the HR department, which is supposed to address employees' grievances. I need to lodge a formal complaint against them in the labor court or labor office. Please help and guide me in obtaining my relieving letter, experience certificate, Form 16, and dues if possible. Dear Vidhivani,

In your long post, two significant factors emerge. One is that you did not serve the notice period, and the second is non-payment of wages, which is an incentive for January and February.

Why did you not apply for Leave Without Pay (LWP)? You could have taken 1-2 months of LWP and continued with the employment. Anyway, you may make a formal complaint to the labor office in your area. Please carry with you evidence of your employment.
