I am working with an IT company from 11 months (i.e. from Jan 2nd 2015). As per agreement, after completion of the minimum service period of 1 year by the employee, he would eligible to give 60 days notice of termination.
However, I submitted my resignation on 9th Oct 2015. During our discussion HR asked me to atleast serve the bond period. But now they are telling that I can’t submit my resignation during bond period and asking me to revoke the resignation and submit it on Jan 2nd 2016 as per policy. Now they are telling that they can only relieve me on March 1st and asked me to work from home which will not be possible for me.
I asked my manager to waive off my notice period as this an emergency. He is telling that his superior is not accepting as that amount will be deducted from BU Head Account and he is not ready to bear the loss. I’m getting mental stress everyday. Please advice me on this matter.

My view is that after serving the bond period write a letter to your HR stating you have completed your bond period as you discussed earlier & ask him/her to relive you from service and also note the date your submission of resignation letter which leads to the discussion in the letter. Mentioning this in the letter make HR to realize his/her words (Atleast serve the bond period) during the discussion hence as a good HR he/she stand by their words.
Even after they insisted you to serve the notice period than pay for the notice period in lieu of serving the notice period and relive yourself from the company it is legal according to law.
My point is you are not liable to pay or serve for the notice because you submitted the resignation letter within the period of one year and because of the discussion with HR you decided to serve the bond period (State this two lines in your letter).
