Can you give me some advice regarding the 13th-month pay for employees who are on unpaid leave and maternity leave? Will they still be given the 13th-month pay, or will the unpaid months be deducted from their 13th-month pay?

Hi,
The minimum 13th-month pay required as per the Philippines Department of Labor and Employment shall not be less than one-twelfth of the total basic salary earned by an employee within the calendar year, provided the employee worked for at least one month during the calendar year. If the period of the calendar year includes unpaid leave, then payment of the 13th-month pay is entitled to this monetary benefit "in proportion to the length of time he worked during the year".
