Dear Sir,
I have resigned from a private limited software company in 2013, after servicing 4 years and 224 days continuously. In my offer letter , gratuity is mentioned as part of CTC.HR at the time of releiving said that Gratuity is eligible only after 5 years completed service. Am i eligible for Gratuity from the employer? The company's working days are 5 days per week.

Dear Ajish, Submit a request letter to your previous employer for settlement of Gratuity. If they fail to settle Gratuity within 30 days, approach area Labour commissioner.

The HR of your past company is very right in saying that Gratuity is eligible only after 5 years completed service. In fact I am not willing to contribute more on this subject since I have contributed many times in this topic and almost every time there are contradictory views by our learned members.
