If Gratuity deducted by Company in our CTC SALARY Break-up, but if we do not complete my 5 year of job & laps the duty in between ,suppose after 3 years,? so what is the rules, company is liable to pay Gratuity to us for 3 year bcz Company deducted the amount in our CTC break-up. & what is the legal procedure if company have not pay deducted gratuity amount . pls reply

Dear Sir,
It's very useful calculation sheet. As per the payment of Gratuity Act, service period => 6 months counted as one year and < 6 months not taken in to consideration. In the given sheet service period between 3 to 9 months counted as half year and more than 9 months counted as full year. Can you please modify this and share with the members ?

ya its good calculator for Gratuity .but I have ask simple question that If gratuity deducted by company in CTC breakup- so can we liable for gratuity before 5 years completed job. or not bcz compant deducted gratuity in our CTC salary

Dear Sameer,
If you worked 240 days in your fifth year than you will be eligible for the gratuity.
In these eleven month except sunday you worked more than 240 days.So you are eligible for the gratuity.
So you can go to the Labour court against your organization.
