I am working in a private company, and the management is giving salary in parts after 3 to 4 months. The management states that the reason behind the delayed salary is insufficient funds. We have been facing this issue for 2 years. Initially, we thought of cooperating with the company during difficult times, but now this has become a habit. Currently, all employees are struggling to receive their salaries. Some former employees have filed legal cases with the Labor Department, but there have been no results. Could anyone please advise me on how I can receive my salary as soon as possible?

If you are working as a contractor company, please file a complaint with the concerned ALC or LEO under the CLRA Act. If you are working as a PE and receiving a salary less than Rs. 18,000, please file a complaint under the Payment of Wages Act as well.

Since you are working in Surat, you are governed by Bombay shops and establishment Act. For delayed wages, make complaint to inspector under the said Act. Thanks Sushil

Make a complaint to the inspector under the Bombay Shops and Establishment Act, which is applicable in Gujarat as well. The delayed wages are recoverable under the Payment of Wages Act since the limit of Rs. 18,000 per month does not apply in this case. After filing a complaint for yourself and in other cases, also separately request information under the RTI Act regarding the steps taken to recover the dues.

I do not want to get into the legalities. Once you get a new job, take an experience certificate (which will always be helpful, no matter what the size of your present company is) and move on. It is easier said than done, but I would suggest you write off this dues. If you file suit, it can drag on up to 3 years. I guess your salary dues are between $20,000 and $40,000 (average of 3 months' salary). It is not ordinary money, but when compared to the time you need to spend in court, sacrificing your working hours and associated stress, it is better to write off the money. I say this because, even if you win the case, the employer might still refuse to pay, citing a fund crunch. They may even file for bankruptcy, and you will receive only a meager amount, and that too after years. Forget this and move on. Don't waste your time and energy over this and do well in your new workplace.
