Dear Friend,
If you are residing in Mumbai, then you can refer to the Bombay Shops & Establishment Act, 1948. Otherwise, you can refer to your organization's HR policy. There is a contradictory one here that if your company is involved in Sales Promotion activities, then you can refer to the Sales & Promotion Employees Act, 1976.
Please feel free to ask any queries!
Best regards,

Are you in health care or are you an NGO ? You need to follow the Bombay shop and establishment act And also the standing orders of Maharashtra state (if you have more than 50 employees)

Holidays with pay are allowed under various acts and are in accordance with the type of industry, contract, custom, and usage. Some of the major laws that define leaves are the Factories Act, Shop and Establishment Act, Apprentice Act, Sales Promotion Act, and Model Standing Orders. Since yours is an NGO, it would be governed by the respective state's Shop and Establishment Act. You can refer to the said Act and accordingly devise the leave rules.

The leave applicable shall be governed by the enactment applicable, e.g. (name of the state) Shops and Commercial Establishment Act.
The establishment can provide superior benefits but not inferior.

I am working in a company which is a distributor and promoter in Himachal Pradesh for a mobile phone manufacturing company. We are recruiting a sales manager, promoters, team leaders, etc.
I am in the process of making a leave policy. However, I am confused about whether the Sales Promotion Employees Act will apply. If so, what will be the criteria for selecting employees on whom this act will be applicable? Is there any wage limit? Or should the leave policy be made as per the HP Shops and Commercial Establishment Act?
Regards,
Karun
