Hi Colleagues,

What is the process to terminate an employee on grounds of continued indiscipline post receiving a warning letter, lack of respect for hierarchy, and lack of team spirit? Is there a necessity to furnish a show cause notice?

Awaiting your valued response.

Warm regards.

Yes, you should issue a show cause notice describing the charges and ask him to show reasons why action should not be taken against him for his continued misconducts. The charges should be specific, showing what misconduct he committed, the date, and the time of the incident, allowing him a reasonable time to reply. If his response is unsatisfactory, proceed with a domestic inquiry by appointing an Enquiry Officer. Follow the procedures and then make a decision based on the Enquiry Officer's report. Terminating based solely on two or three warning letters may render the termination illegal.
