Proprietorship firm wants to change the name of the proprietor in PF and ESI registrations. What is the process? The new proprietor is the daughter of the existing proprietor. Please suggest the process. Is there a change in the ST number as well?

Since a new proprietor is taking over the factory or establishment which is already registered with ESIC, compliance should continue using the same code. Any necessary changes regarding the proprietor, bank account, etc., can be made by applying online at www.esic.in. For any other specific queries, please address them to dahiyams@hotmail.com.

There is no concept as such of a change of proprietor. The business of a proprietor has no independent existence; it is an extension of the proprietor. So, in the change of proprietor, it amounts to the sale of the business, and the same procedure will be necessary.

If you do want the business continuity, then it may be a good idea to convert it into a partnership. Please speak to your CA or tax advisor and figure out what you need to do.

If there is any change of owner, you have to submit Form 5A to RPFC. Similar provisions are there for ESI also, i.e., annual information. If by change of proprietor, the name(s) of employer(s) already given to the authorities are not changed, then there is no need to inform them.
