Dear All,

I work in an IT firm, and an employee absconded from the organization. In our organization, if an employee wants to quit, then he/she has to serve the notice period of 2 months. Also, at the time of joining, the employee has to sign the bond for a period of 1 year. The employee who absconded neither served the notice period nor completed one year with the company.

We don't want to take legal action against him/her, but we have to send a termination letter. Now I need your help to create a termination letter by clearly stating all the violations by him.

Please help me.

Hello Jiya,

Please share if your employer has issued any show-cause notice to the employee.

* If not shared yet, please issue the first show-cause notice to him/her at the Postal Address via registered mail.
* If no reply is received, issue another show-cause notice within 7 days.
* If still no reply is received, issue another show-cause notice.
* Inform the labor department of your concern.
* If no reply is received, post an advertisement in the newspaper informing him/her that if they are unable to attend the office on XYZ date, we will terminate their candidature with us. This step is optional.
* Finally, issue a termination letter with full and final settlement.

Seniors, please shed more light on this.

1. Firstly, advertise through the local newspaper himself as absconding and seeking his presence to report to the company. Grant 15 days; else failure leads to termination.

Subsequently, send him a termination order mentioning circumstances and for the failure of presence and reporting to the company.
