I\'m working in a private limited company in Ahmedabad,Gujarat as trainee engineer..
I have signed a notarized bond for two years and notice period is of one month...
Now my bond ends in June,2014 so can I put my resignation in May, 2014 or do I need to wait till the bond expires and then put resignation?
Please help!!!!

Notice period is part of service period. Technically, you are completing the bond period incl. the notice period serving. You can submit the resignation one month before the bond expiry date and get relieved on the next day of bond expiry period.

It depends on Company’s discretion whether they would accept your resignation after expiry of your bond period or not.Even they can waive off your one month notice pay if they desire so.

Such bonds might not have any legal validity. Such bonds or clauses in the agreement might be considered as a penalty clause and is invalid under Indian Contract Act. Employers does not have any right to prevent a person from leaving the job without paying the bond amount, except in certain conditions like, where the employer has paid for any training course (employers should be able to produce certificates, proof of cost of such trainings, etc), generally inhouse superficial training might not have much value.

Need help on a critical matter.I had joined a BPO in 2006 first day I was called to receive the appointment letter when I went there they asked me to fill a form mentioning my previous job details i.e tenure and all.Since I did not remember the exact date at that point in time as I was not carrying my docs, I filled apprx dates for two companies unintentionally which were 10-15 days varying with actual dates which I realized later on when the company verified with my previous employer and HR started harassing me day and night within 4-5 days of joining .I was so mentally tortured that I asked them to take my resignation but they continue summoning me at HR office and harassing .Almost on the 14th day of joining when I was on job training they asked me to put the resignation mentioning that I have given the wrong details thats why I am resigning.I left that company and joining some other company on better position and till my last job I got three four promotions on my performance.

Though they did not give me any specified training and the 2-3 days training was inhouse only ,most of the time 10days I was on job trainie.In appointment letter I suppose there was 2 years bond.Though they have sacked me still they have taken legal action against me ,I used to get summons which i did not accept ,in one court it order was in their favor as I did not fight against them.

Now I had to file legal paper agaist there summons but my adv is asking lot of money ,if I compromise then also I have to give lot of money.

I am really in pain as there is no fault of mine ,I have been mentally harassed ,still I have to give so much of my hard earned money.Can anyone help me out getting out of this situation .

As it was the forced resignantion so the company could not go to the court.if the company goes to court the decision will be in your favor. regards Sultan,Pakisatn

You can submit resignation in May itself, which terminates the bond. Serving 1 month notice period satisfies valid the termination of bondas well your regular resignation mode too. No need to panic.
