Hi,

I worked for a company for two months as a fresher, then my mother got ill (spinal injury), and I had to leave that job without serving the notice period. I did inform my managers and told them about my inability to join the company again. They asked me to write that formally and to meet them once, but due to the seriousness of my mother's health, I wasn't able to complete the formalities.

After two months, I received the termination letter from the company.

Two months after the termination letter, I received a letter from the same company stating that they are doing full and final settlement and I have to pay more than 15k to get my relieving letter. The letter also states that if I don't give them the required amount, they will initiate appropriate actions against me.

I don't want any experience letter.

Can anybody tell me:

1) What are the actions that a company can take against me if I do not pay that amount?

2) If I don't get my relieving letter, what kind of problems would I have to face in the future?

Please help.

Please check the appointment letter with regards to the termination clause. Secondly, what is the amount of 15K your company is asking for? Please let the forum know the details so as to advise appropriately.

Regarding your query:

1) If the company has provided you with training for which an amount equal to 15k was spent, then you are supposed to pay it (assuming a lack of appointment clause). Otherwise, the company can initiate legal action if necessary (though typically larger companies do not pursue this for such a small amount).

2) The termination letter itself serves as your release from the job. For your future, you will need to apply as a fresher.

The company is asking me to pay in lieu of notice. The termination clause states that an employee has to serve a notice period of one month or pay in lieu of the notice period. I didn't serve the notice period because I had to stay with my mom. I guess I have to pay in lieu of notice now. :(

If you have genuine reasons for not reporting to duty, write to them explaining the circumstances and conditions that necessitated the discontinuance. It is not appropriate to join another company by providing false excuses to your previous employer. If your reasons are valid, you may disregard their notice if you have not undergone any specialized training.
