Dear seniors,

I am working as an HR professional in a pharmaceutical marketing company based in Chennai. We have around 300 employees in sales and marketing working in different states all over India. We do not have branch offices other than in Chennai.

We are starting deductions for professional tax for our office employees. My question is, can we deduct professional tax for our field employees (medical representatives), and do we have to pay at the Chennai corporation...?

Please clarify.

Hi,

As you are confirming that you do not have any branch offices other than Chennai, we would suggest deducting the PT from all your employees and remitting it to the Chennai corporation. Since it is the sole responsibility of the employer to deduct the PT from the appropriate/applicable employees and remit it to the local body, this can be initiated now.

Suppose, if an employee can submit their PT at their local corporation as per the local slab rate:
1. Can we also deduct this here in Chennai?
2. Must we reimburse the actual payment they have already made?
