I need help to solve my dispute with my MNC Company on resignation. I had to serve a 3-month notice period, and I served 2 months with a 1-month buyback option. My company's Exit policy has a clause that allows 1 month settlement against accrued leaves. However, my company is forcing me to pay one month's gross salary and avail reimbursement on my leaves. I will be losing out on my settlement amount if I pay 1 month's gross salary and get reimbursed for the leaves as the leaves are calculated based on the basic pay component alone.

Please suggest how I should address this issue with my company. I sent my HRBP a copy of the Exit policy, and they are not responding to it.

Dear Murali,

Please ask your company for the full and final settlement policy. If they are not abiding by the policy, you can request them to do so. If they still do not comply, you can escalate the matter to the grievance redressal machinery or the Ombudsman in your company. Lastly, you can seek resolution through the labor court.

Where are you based at present? In your details, it is showing up as St. Louis. In the states of the US, the notice period policy is different. Many states in the US follow the "At-will employment" policy. Please clarify.
