Hi All,
Due to internal situation of the team,my manager is not ready to relieve me within the actual notice period.
I respect his explanation. However I m in a situation to leave the company after serving half of the notice period.
It is mentioned in my appointment letter also that I can serve notice or payout for the notice period and no need to provide any reason.
However ,internally neither HR or my manager is agreeing to this and stating that the approval is needed.Since I have initiated my resignation via tool and mail mentioning the expected exit date,will it be considered as termination/abscond if I leave before serving complete notice period.And I am worried ,if I get a negative feedback from this employer,this will impact my employment with other employers.
Note: 1. my decision to move is due to personal situation
2. my new employer is not flexible with joining date ,due to some dependency with their customer
3.I have notified my manager formally for my resignation and I'm leaving after serving notice of 30 days, where my actual notice is 2 months.
4.I want to make complete my exit formalities without any issues for me or my present company.

Here in spite of clear agreement and your willingness to pay for remaining days, if your company does not leave you, decision has to be taken of quitting with a clear letter explaining whole situation and enclosing a cheque for one month notice
You may get poor reference from the company.
That is a risk which you need to factor in.
Have you spoken/written to higher authorities-level above reporting manager and HR?
Exit may lead to bad blood and delay in F & F and poor references.
So the ball is in your court.

Hi Nathrao, Yes I spoke with next level people as well.Didn’t help. 1.Will they provide me relieving letter 2.will it be considered abscond

Give the company a final resignation letter along with Payment of 30 days notice period.
The company may terminate and your services and give bad feedback to your new employer.
Are you a permanent employee of present company?
They cannot make it an absconding case.
All depends on what is written in your agreement for exit.

Dear Friend,
The first mistake you have done by giving a date to your new employer which falls within your notice period. In general firms take stand for serve of notice period than the notice amount to keep pressure on employee.
What is understood from your posting in regard to relive from job has remained in verbal stage and you received nothing in writing from the management.
You need to discuss with your would be employer whether they are ready to take you without the relive letter. If they don't have any issue in accepting you without the doc. Then you write a letter mentioning that[ this is as per discussion I had with you on dt. as my resignation dt..... already have served notice of 30 days and paying Rs..............in leiu of notice for 30 days, towards the compliance of notice. Hence, here in after my last date of working is closing hour of dt..next day of 1st 30 days notice). This can help you in future if there any legal complication.
